THE RAJASTHAN VALUE ADDED TAX ACT, 2003 Notifications - HISTORY

Whereas, an unprecedented fire broke out on October 29, 2009, in the depot of the Indian Oil Corporation Limited, at Sitapura Industrial Area, Jaipur resulting in extensive damage to the various industrial units and other registered dealers having place of business in the Sitapura RICCO Industrial Area, Jaipur and/or Export Promotional Industrial Park (EPIP), Sitapura, Jaipur.

And whereas, to help such registered dealers, it is felt necessary by the State Government to defer the tax payable by them for the months of October, 2009 to September, 2011, as a part of revival packages.

Now, therefore, in exercise of the powers conferred under sub-section (3) of Section 20 of the Rajasthan Value Added tax Act, 2003 (Act No. 4 of 2003) and section 9 of the Central Sales Tax Act, 1956 (Central Act No. 74 of 1956), the state Government being of the opinion that it is expedient in the public interest so to do, hereby defer the payment of tax payable by the registered dealers having the place of business within Sitapura RICCO Industrial Area, Jaipur and / or Export Promotional Industrial Park at Sitapura, Jaipur, for the months of October, 2009 to September, 2011, subject to the following conditions, namely:-

(i) that the registered dealers having availed the benefit of deferment of tax shall pay the amount of tax so deferred in six equal monthly installments commencing from the month of October, 2011, on 7th day of the month without interest.

(ii) the tax deferred under this notification shall be treated as a loan,

(iii) the such dealers shall comply with all the provisions of the Rajasthan Value Added Tax Act, 2003, the Central sales Tax Act, 1956 and the rules made thereunder.

(iv) that no further deferment of tax shall be granted.
